Regulamin sklepu

§1. Postanowienia ogólne

  1. Sklep internetowy dostępny pod adresem www.sandranajda.com/sklep prowadzony jest przez Sandrę Najdę, zamieszkałą w Warszawie, Polska.
  2. Kontakt ze sprzedawcą: sandra.najda@gmail.com
  3. Regulamin określa zasady korzystania ze sklepu, składania zamówień, dostawy, płatności oraz reklamacji.

§2. Definicje

§3. Produkty

  1. Wszystkie produkty w Sklepie są oryginalnymi dziełami sztuki wykonanymi przez Sandrę Najdę.
  2. Każdy obraz jest unikatem i posiada certyfikat autentyczności podpisany przez artystkę.
  3. Zdjęcia produktów mogą nieznacznie różnić się od rzeczywistości ze względu na ustawienia monitora.
  4. Ceny podane w Sklepie są cenami brutto wyrażonymi w złotych polskich (PLN).

§4. Składanie zamówień

  1. Zamówienia można składać 24 godziny na dobę, 7 dni w tygodniu.
  2. W celu złożenia zamówienia należy wybrać produkt, kliknąć „Kup teraz" i wypełnić formularz zamówienia.
  3. Złożenie zamówienia stanowi ofertę zawarcia umowy sprzedaży.
  4. Po złożeniu zamówienia Klient otrzymuje potwierdzenie na podany adres e-mail.
  5. Umowa sprzedaży zostaje zawarta z chwilą zaksięgowania płatności.

§5. Płatności

  1. Sklep umożliwia płatność za pośrednictwem:
    • Systemu Stripe (karty płatnicze, BLIK, Przelewy24)
    • Przelewu bankowego na konto Sprzedawcy
  2. Płatności obsługiwane są przez Stripe, Inc. zgodnie z regulaminem dostępnym na stripe.com.
  3. Klient zobowiązany jest do dokonania płatności w terminie 7 dni od złożenia zamówienia.
  4. W przypadku braku płatności w terminie, zamówienie zostaje anulowane.

§6. Dostawa

  1. Dostawa realizowana jest na terenie Polski i za granicę.
  2. Koszt dostawy w Polsce wynosi 200 zł (kurier z ubezpieczeniem).
  3. Koszt dostawy zagranicznej ustalany jest indywidualnie.
  4. Czas realizacji zamówienia wynosi 3-7 dni roboczych od zaksięgowania płatności.
  5. Obrazy są profesjonalnie pakowane w celu zapewnienia bezpiecznego transportu.

§7. Prawo odstąpienia od umowy

  1. Konsument ma prawo odstąpić od umowy w terminie 14 dni bez podania przyczyny.
  2. Termin do odstąpienia wygasa po upływie 14 dni od dnia otrzymania produktu.
  3. Aby skorzystać z prawa odstąpienia, należy poinformować Sprzedawcę o swojej decyzji w drodze jednoznacznego oświadczenia (e-mail lub list).
  4. W przypadku odstąpienia Sprzedawca zwraca wszystkie otrzymane płatności, w tym koszty dostawy, nie później niż 14 dni od otrzymania oświadczenia o odstąpieniu.
  5. Klient ponosi bezpośrednie koszty zwrotu produktu.
  6. Prawo odstąpienia nie przysługuje w przypadku produktów wykonanych na indywidualne zamówienie Klienta.

§8. Reklamacje

  1. Sprzedawca odpowiada za wady produktu na podstawie przepisów Kodeksu cywilnego o rękojmi.
  2. Reklamacje należy zgłaszać na adres e-mail: sandra.najda@gmail.com
  3. Reklamacja zostanie rozpatrzona w terminie 14 dni od jej otrzymania.

§9. Obrazy na zamówienie

  1. Możliwe jest zamówienie obrazu wykonanego na indywidualne zamówienie.
  2. Proces realizacji obejmuje: konsultację, zatwierdzenie projektu, wpłatę zaliczki (50%), realizację, wpłatę pozostałej kwoty.
  3. Zaliczka jest bezzwrotna i stanowi zabezpieczenie realizacji zamówienia.
  4. Czas realizacji obrazu na zamówienie wynosi około 2 tygodnie.
  5. Prawo odstąpienia nie przysługuje w przypadku obrazów wykonanych na zamówienie.

§10. Własność intelektualna

  1. Wszystkie prawa autorskie do dzieł pozostają własnością artystki Sandry Najdy.
  2. Zakup obrazu nie przenosi praw autorskich na Klienta.
  3. Klient nie może reprodukować, rozpowszechniać ani wykorzystywać obrazu w celach komercyjnych bez pisemnej zgody artystki.

§11. Postanowienia końcowe

  1. Sprzedawca zastrzega sobie prawo do zmiany Regulaminu.
  2. Zmiany wchodzą w życie w momencie ich opublikowania na stronie Sklepu.
  3. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają przepisy prawa polskiego.
  4. Wszelkie spory będą rozstrzygane przez sąd właściwy dla siedziby Sprzedawcy.

§1. General Provisions

  1. The online store available at www.sandranajda.com/sklep is operated by Sandra Najda, residing in Warsaw, Poland.

  3. These Terms and Conditions define the rules for using the store, placing orders, delivery, payment, and complaints.

§3. Products

  1. All products in the Store are original works of art created by Sandra Najda.
  2. Each painting is unique and comes with a certificate of authenticity signed by the artist.
  3. Product photos may slightly differ from reality due to monitor settings.
  4. Prices in the Store are gross prices expressed in Polish zlotys (PLN).

§4. Placing Orders

  1. Orders can be placed 24 hours a day, 7 days a week.
  2. To place an order, select a product, click "Buy now" and fill in the order form.
  3. Placing an order constitutes an offer to conclude a sales agreement.
  4. After placing an order, the Customer receives confirmation to the provided email address.
  5. The sales agreement is concluded upon payment being credited.

§5. Payments

  1. The Store enables payment via:
    • Stripe system (payment cards, BLIK, Przelewy24)
    • Bank transfer to the Seller's account
  2. Payments are processed by Stripe, Inc. in accordance with the terms available at stripe.com.
  3. The Customer is obliged to make payment within 7 days of placing the order.
  4. If payment is not made within the deadline, the order will be cancelled.

§6. Delivery

  1. Delivery is carried out within Poland and abroad.
  2. Delivery cost in Poland is 200 PLN (courier with insurance).
  3. International delivery cost is determined individually.
  4. Order fulfillment time is 3-7 business days from payment being credited.
  5. Paintings are professionally packed to ensure safe transport.

§7. Right of Withdrawal

  1. The Consumer has the right to withdraw from the contract within 14 days without giving any reason.
  2. The withdrawal period expires 14 days from the day of receiving the product.
  3. To exercise the right of withdrawal, you must inform the Seller of your decision by an unequivocal statement (email or letter).
  4. In case of withdrawal, the Seller will refund all payments received, including delivery costs, no later than 14 days from receiving the withdrawal statement.
  5. The Customer bears the direct costs of returning the product.
  6. The right of withdrawal does not apply to products made to the Customer's individual order.

§8. Complaints

  1. The Seller is responsible for product defects under the provisions of the Civil Code on warranty.
  2. Complaints should be submitted to: sandra.najda@gmail.com
  3. Complaints will be processed within 14 days of receipt.

§9. Commission Paintings

  1. It is possible to order a painting made to individual order.
  2. The process includes: consultation, design approval, deposit payment (50%), creation, remaining payment.
  3. The deposit is non-refundable and serves as security for order fulfillment.
  4. Completion time for commission paintings is approximately 2 weeks.
  5. The right of withdrawal does not apply to commission paintings.

§10. Intellectual Property

  1. All copyrights to the works remain the property of artist Sandra Najda.
  2. Purchasing a painting does not transfer copyrights to the Customer.
  3. The Customer may not reproduce, distribute, or use the painting for commercial purposes without written consent from the artist.

§11. Final Provisions

  1. The Seller reserves the right to change these Terms and Conditions.
  2. Changes come into effect upon their publication on the Store website.
  3. In matters not regulated by these Terms and Conditions, Polish law shall apply.
  4. Any disputes will be resolved by the court having jurisdiction over the Seller's place of business.
